1. Scope

1.1 These General Terms and Conditions (“Terms”) apply to all contracts concluded via the gymanimals online shop between Orius IT-Solutions e.U., Huglgasse 11/8, 1150 Vienna, Austria (“we”, “us”) and our customers (“you”).

1.2 Our offer is directed at consumers and businesses. Where these Terms distinguish, “consumer” means a consumer within the meaning of the Austrian Consumer Protection Act (KSchG) or the corresponding law of your country of residence; “business” means anyone who is not a consumer.

1.3 If you are a business, your own terms and conditions do not apply unless we expressly agree to them in writing.

2. Conclusion of the contract

2.1 The presentation of products in our online shop does not constitute a binding offer but an invitation to place an order.

2.2 By clicking the button “Pay now” at the end of the checkout process, you submit a binding offer to purchase the products in your cart. Before submitting, you can review all details of your order and correct any input errors using the usual keyboard and mouse functions or the “Return to …” links in the checkout.

2.3 After you submit your order, you will receive an automatic email confirming receipt of your order. This confirmation of receipt does not yet constitute acceptance of your offer.

2.4 The contract is concluded when we accept your offer by shipping the goods or by sending you a shipping confirmation email, at the latest within 7 business days after you have submitted your order. We are free to decide whether to accept an order. If we do not accept your offer within this period, you are no longer bound by it, and any amount already paid will be refunded to you without delay using the same means of payment.

2.5 We only sell in quantities customary for private households.

2.6 The contract languages are English and German. We store the contract text. You will receive the order details and these Terms by email; the current Terms are available at any time on this page.

3. Products

3.1 All products are printed individually for each order (“print on demand”) by our production partner and shipped directly to you.

3.2 Product images are illustrations (mockups). Due to the printing process and different screen settings, minor deviations in colour and print placement are possible. Your statutory warranty rights remain unaffected.

4. Prices and shipping costs

4.1 Prices for deliveries within the EU are final prices including the applicable statutory VAT. Shipping costs are shown separately in the cart and in the checkout.

4.2 For deliveries to countries outside the EU, additional customs duties, taxes or fees may be charged by the authorities of the destination country and are payable by you, unless stated otherwise in the checkout.

4.3 Prices may be displayed in your local currency. The amount charged is the amount shown in the checkout.

5. Payment

5.1 You can pay by credit or debit card, Apple Pay, Google Pay, Shop Pay, PayPal or Klarna. The payment methods available for your country are shown in the checkout.

5.2 The purchase price is due when you place your order. Production only starts after successful payment. If we do not accept your order, we will refund the full amount without delay.

6. Production and delivery

6.1 We deliver worldwide to the countries offered in the checkout.

6.2 Production usually takes 2–5 business days after receipt of payment; the shipping time is added. The estimated delivery time is shown in the checkout and in our Shipping information.

6.3 If a product cannot be delivered, we will inform you without delay and refund any payments already made.

7. Retention of title

The goods remain our property until full payment of the purchase price.

8. Right of withdrawal

Consumers have a statutory right of withdrawal. Details and the model withdrawal form can be found on our Right of withdrawal page. You can also withdraw online using the “Withdraw from contract” function, which is linked in the footer of every page of our shop (Withdraw from contract).

9. Warranty

9.1 The statutory warranty provisions apply (for consumers in particular the Austrian Consumer Warranty Act, VGG). The warranty period is two years from delivery. If a defect becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery. Before you place your order, you can find the EU-harmonised notice on your statutory warranty rights on every product page and in the cart; we also include it in your order confirmation email.

9.2 If a product is defective or misprinted, please contact us at shop@orius.at, ideally with a photo, so we can arrange a replacement or refund quickly. This does not restrict your statutory rights.

10. Liability

10.1 We are liable without limitation for damage caused intentionally or through gross negligence.

10.2 We are not liable for property damage or financial loss caused by slight negligence.

10.3 The exclusion in 10.2 does not apply to personal injury, to claims under the Austrian Product Liability Act (PHG) or to your statutory warranty rights.

11. Designs and intellectual property

All designs, texts and images in this shop are protected by copyright. Any use beyond private use requires our prior written consent.

12. Data protection

Information on the processing of your personal data can be found in our Privacy Policy.

13. Applicable law and place of jurisdiction

13.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-law rules. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the state in which they have their habitual residence.

13.2 For consumers, the statutory place of jurisdiction applies. For businesses, the court in Vienna having subject-matter jurisdiction is agreed as the exclusive place of jurisdiction.
